Terms of Service
These Terms of Service ("Terms") govern your use of Dailymark (the "Application"), a mood tracking application operated by Mojinge Studio ("we", "us", "our"), a product team based in Nanning, Guangxi, China. By opening or using the Application you agree to these Terms. If you do not agree, please do not use the Application.
1. What Dailymark does
Dailymark lets you record a daily mood rating and optional activity tags, view those entries as a calendar, and — on paid plans — receive statistical observations derived from the entries you have recorded.
Dailymark is a self-tracking and journaling tool. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease or condition, and must not be used as a substitute for professional advice, diagnosis, or treatment. If you are experiencing a mental health crisis, contact a qualified professional or your local emergency services.
2. Accounts and eligibility
The free tier of Dailymark requires no account. You may use the Application without registering and without providing any personal information.
If you purchase a paid plan, you will be asked for an email address at checkout in order to receive your receipt, license key, and access to manage your subscription. You must be legally able to form a binding contract in your jurisdiction to purchase from us. If you are under 18 years of age, you must have the consent of a parent or guardian to purchase a paid plan.
3. Licence to use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Application for your own personal or internal purposes, subject to these Terms and any plan limits you have purchased.
Unless we grant it to you in writing, you may not: copy, modify, adapt, translate, reverse engineer, decompile, or attempt to derive the source code of the Application; resell, sublicense, rent, lease, or provide the Application to third parties as a service; distribute, publish, or make the Application available in any form; remove or alter any proprietary notices; or use the Application in a way that violates applicable law or infringes the rights of others.
4. Your content
You retain all rights to the mood ratings, tags, notes, and other content you enter into Dailymark ("Your Content"). Because the free tier of the Application stores Your Content locally in your own browser and does not transmit it to us, you are the sole custodian of that data.
You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, process, transmit and display Your Content to the extent required to operate the Application and to provide the paid features you have purchased. This licence ends when you delete your content or close your account.
You are responsible for Your Content and for making sure you have the right to enter it. We do not review, monitor, or moderate content entered into your own local journal, and we do not use it to train any model.
5. Purchases, subscriptions and refunds
5.1 Payment processing
Payments are processed by Creem, our third-party merchant of record. Creem acts as the legal seller of record for digital products sold through the Application, which means Creem collects and remits any applicable sales tax, VAT, or GST, issues the invoice or receipt, and handles payment disputes. Your payment details are entered on Creem's secure checkout and we never receive or store your card number.
5.2 Plans
The free tier includes unlimited entries, the full-year calendar view, one year of history, JSON and CSV export, and PNG image export. Paid plans ("Premium") add unlimited history beyond the first year, statistical insights, and custom activities. Premium is offered as an annual subscription or as a one-time lifetime purchase. Prices are shown in US dollars and may change; any change applies to future purchases only and never retroactively.
5.3 Subscriptions
If you purchase an annual subscription, it renews automatically at the end of each term at the then-current price until you cancel. We will send a confirmation email at the time of purchase. You can cancel at any time through the customer portal linked in your receipt email, or by contacting us at hello@mojinge.cloud. Cancellation stops future renewal; your access continues until the end of the paid period.
5.4 One-time purchases
A lifetime purchase is a single payment with no renewal. We do not offer subscriptions in the sense of an automatically recurring charge for the lifetime plan.
5.5 Refunds
If you are not satisfied with a paid plan, contact us within 14 days of purchase and we will refund it. Because your journal data stays on your own device and remains exportable whether or not you have an active plan, we cannot refund a plan on the grounds that you have already used paid features. Statutory rights of consumers under the mandatory laws of your country of residence are not affected by this policy.
5.6 Taxes
Prices are shown excluding any sales tax, VAT, or GST that may apply in your location. Where required, Creem calculates, collects, and remits that tax at checkout. If you are outside China, you may be responsible for taxes on your own income received from us.
6. Acceptable use
You agree not to use the Application to: violate any law or regulation; interfere with or disrupt the Application or its underlying infrastructure; attempt to gain unauthorised access to any system or data; probe, scan, or test the vulnerability of any of our systems except as expressly authorised by us in writing; scrape or harvest the Application; circumvent, disable, or tamper with any paid-feature mechanism including license keys, activation limits, or usage verification; resell access to the Application; or upload content that is unlawful, infringing, or that you do not have the right to use.
7. Availability and changes
We work hard to keep the Application available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature or the entire Application at any time, with or without notice. If we discontinue the Application, we will provide a refund of the unused portion of any prepaid subscription period.
8. Intellectual property
The Application, including its software, design, text, graphics, and the "Dailymark" name and branding, is owned by Mojinge Studio and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Application and your license key as permitted by these Terms.
9. Third-party services
The Application links to third-party services, including the payment processor (Creem) and links to our other products. We do not control and are not responsible for third-party services. Your use of them is governed by their own terms.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. The statistical observations the Application produces are informational and are derived from data you entered; they are not medical, psychological, or professional advice, and we do not warrant that any observation is correct or applicable to you.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Application, even if we have been advised of the possibility of such damages. Because your journal content is stored only on your device, we are not responsible for any loss of that content caused by clearing your browser data, a device failure, or actions taken by a third party.
Our total aggregate liability arising out of or relating to the Application shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Indemnity
You agree to indemnify and hold harmless Mojinge Studio and its team members from any claim, demand, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the Application in breach of these Terms, or your violation of any third party's rights.
13. Termination
You may stop using the Application at any time and delete your local data at any time. We may suspend or terminate your access if you materially breach these Terms, particularly the acceptable use provisions in Section 6. On termination, your licence to use the Application ends, and any unpaid fees become due immediately, except where termination is caused by our breach.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. If a change is material and affects your rights, we will make reasonable efforts to notify you by email before it takes effect. Continuing to use the Application after the updated Terms are posted constitutes acceptance of the changes.
15. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law rules. If you are a consumer resident in the European Union or the United Kingdom, you retain the protection of mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of your country of residence. Where legally permitted, the parties submit to the exclusive jurisdiction of the courts of the People's Republic of China. Before filing any claim, please contact us first — most disputes are resolved quickly by email.
16. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mojinge Studio regarding the Application.
